1. Introduction
Welcome to Marintelligence. These Terms of Service ("Terms") govern your access to and use of the Marintelligence website and our application, SAM (Sailing Assistance Mate) (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
SAM is an AI-powered assistant designed to provide troubleshooting, guidance, and maintenance suggestions for yacht captains and crews.
IMPORTANT DISCLAIMER:
The Service is provided for informational and assistance purposes only. It is NOT a replacement for professional maritime training, judgment, or official charts and documentation.
You, as the Captain or user, remain solely responsible for the safety of the vessel, crew, and passengers. Always verify critical information from official sources. Marintelligence is not liable for any accidents, damages, or errors resulting from reliance on the AI's suggestions.
3. User Accounts
- You must create an account to access certain features of the Service.
- You are responsible for safeguarding your password and for all activities that occur under your account.
- You agree to provide accurate and complete information during registration.
- We reserve the right to suspend or terminate your account if you violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
- Attempt to gain unauthorized access to the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to generate content that is harmful, threatening, abusive, or otherwise objectionable.
5. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Marintelligence and its licensors. The Service is protected by copyright, trademark, and other laws.
6. Subscription and Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
We reserve the right to modify subscription fees at any time. Any subscription fee change will become effective at the end of the then-current Billing Cycle.
Right of Withdrawal (EU Users)
If you are a consumer based in the European Union, you normally have the right to withdraw from a contract within 14 days without giving any reason. However, by purchasing a digital content subscription, you expressly agree that we may begin providing the digital content immediately and you acknowledge that you thereby lose your right of withdrawal once the performance has begun.
7. Limitation of Liability
For users not located in the EEA/UK: To the maximum extent permitted by applicable law, in no event shall Marintelligence, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.
For users located in the EEA/UK: Nothing in these Terms shall exclude or limit our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any other liability that cannot be excluded or limited by applicable law.
Subject to the above, we shall not be liable for any indirect or consequential losses, or for any loss of profit, whether direct or indirect, arising out of or in connection with the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Marintelligence is registered, without regard to its conflict of law provisions.
If you are a consumer resident in the European Economic Area (EEA), you additionally enjoy the protection of the mandatory provisions of the law of your country of residence.
9. Online Dispute Resolution (EU)
If you are a consumer in the EU, you can use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes. You can access the platform at: ec.europa.eu/consumers/odr
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
